Terms and conditions of contract

  1. Offer and conclusion of contract
  1. Following contractual obligations shall apply to all contracts between Paaschburg & Wunderlich GmbH and the Purchaser. Our terms and conditions of sale shall prevail over any terms and conditiones in the Purchaser documentation which are inconsistent to those of Paaschburg & Wunderlich GmbH unless otherwise agreed in writing.
  2. Our quotation are not binding in every respect. Orally informations given by our employees only apply when confirmed in writing.
  3. Where makers part numbers are used, these are for reference and discription purposes only and for the avoidance of doubt does not mean that the parts referred to are genuine spare parts made or used by any manufacturer. On invoices to the end customer these numbers shall not appear. When ordering only our part number has to be used.
  4. All goods offered without TÜV homologation, ABE No. or E-No. are not permissible in the area of German STVZO (registration law).
  1. Delivery
  1. Partial deliveries are permissible. Not delivered goods are only taken in backorder if explicit mentioned on the invoice. In all other cases please order again.
  1. Shipment
  1. The goods are send at the Purchser`s risk and costs. The manner of delivery remains at the discretion of Paaschburg &Wunderlich GmbH. We also do not ensure the cheapest way of delivery.
  1. Prices and terms of payment
  1. Our prices are ex- works Hamburg without tax.
  2. Shipping costs to states of EU, to Helvetia and to Norway: If your order is less than 350,- Euro we charge at our costs. Orders which exceed 350,- Euro are carriage free. Excluded are deliveries to islands e.g. Canaries, Belearic Islands, Cyprus, Malta, Faroe etc.
    Shipping costs to other countries: We charge at our costs.
  3. Cash on delivery charges: The charges for cash on delivery have to be payed always and are added to the shipping costs if required. The charges are 6,50 Euro inside Germany and 9,- Euro for shippings to foreign countries.
  1. Transfer of property
  1. The ownership of goods shall remain with the Paaschburg & Wunderlich GmbH until full payment. Until legal ownership of the said goods passes the Purchaser shall keep the goods free from any charge, lien or other encumbrance.
  1. Objection and warranty
  1. 1. Objections because of incomplete, wrong or faulty delivery have to be assert immediately latest within 14 days after receiving the goods and in writing.
  2. 2. We reserve the right to vary any price and any product specifikation at any time. Modification which does not efect the function do not entitle to an objection. We will not held responsible for any consequential losses howsoever caused and in particular will not be responsible for losses occasioned by matters beyond our control.
  3. 3. No guarantee will be assumed for damages caused by wrong fitting, wrong use or if not taken notice of installation and handling instructions.
  1. Returns
  1. 1. The Purchaser has the right to send back the goods within 4 weeks and receive a full refund to the value of the goods with the exception of special orders. All returned goods must be unused and returned in original packaging with the copy invoice along with full written reasons for return. The goods have to be send at the Purchaser`s risk and expense.
  1. Place of performance and jurisdiction
  1. 1. Place of performance und area of jurisdiction is Hamburg. The law of Germany shall apply for any claim or dispute arising from the sale of goods or the supply of services to any customer in any part of the world.
